Land Use Litigation
The escalating costs of real property in and around
Teton County, Wyoming compel many individuals to protect
their property interests both in and out of court. Land
use litigation can entail issues regarding access,
wildlife, clean water, preservation of views, and
fishing rights, to list but a few. Jessica Rutzick has
represented individuals seeking to protect their
property rights, as well as several homeowners’
associations seeking to enforce collective interests –
all with the intention of preserving and enhancing land
value. Our work involves fighting adverse decisions at
the administrative level, as well as litigation in the
district court and before the Wyoming Supreme Court.
Complex Business and Commercial
Litigation
Litigation has too often become part of the cost of
doing business. Over the last ten years, Jessica Rutzick
has successfully defended large and small businesses
against a variety of allegations such as wrongful
termination, negligence, libel, breach of contract and
fraud. Our firm has also successfully prosecuted complex
commercial claims involving embezzlement and fraud. We
have expeditiously assisted our clients in partnership
or corporate dissolution and re-organization. We have
also effectively collected on breach of contract claims
and substantial collection suits.
Insurance Bad Faith Litigation
Insurance companies make it a practice to deny
claims and to minimize claim pay-outs, often against the
interests of their own customers. This is known as
“insurance bad faith.” Jessica Rutzick ensures that her
client’s health care, disability, and accident benefits
are paid according to the insurance contract and in
compliance with the law. She does not hesitate to file
suit to enforce those rights if insurance benefits have
been wrongfully denied.
Personal Injury
Over the years Jessica Rutzick has represented
people who were injured in cars, trucks or motorcycles –
through no fault of their own. Many of our clients have
also been injured at the workplace.
Typically our clients need legal representation when
making claims against either another party’s, and even
their own, insurance company. Our firm specializes in
optimizing claims for medical bills, lost wages and pain
and suffering, either in settlement or at trial.
Although most workplace accidents are covered by Wyoming
Worker’s Compensation, an employee may have an
additional right to compensation if his injury is the
fault of a “third party,” and not his employer. A “third
party” is often the owner of the property on which the
job site is located, or another company that retains
control over the job site. These claims often involve
accidents on drilling rigs or auto accidents. Jessica
Rutzick has helped her clients who were injured on the
job due to another’s negligence or incompetence.
Real Estate Development
Whether you are developing a subdivision, a planned unit
development or need representation before city and
county planning commissions, the Town Council or the
County Commissioners, we have the experience. Our firm
has represented individuals and large scale developers
in planning, administrative presentation and regulatory
interpretation and application. Additionally, Jessica
Rutzick served as interim Town Attorney between August
2005and August 2006, where she developed strong working
relationships with City planners and appointed
officials, and honed her legal and procedural skills for
the “ins and outs” of the development process.
Strategic Business Formation and
Planning
Formation of corporations and limited liability
companies is the first step in protecting hard-earned
assets and earnings. With our firm’s assistance, our
clients can be proactive in litigation avoidance with
thoughtful and thorough written contracts, contract
review and corporate structuring. Jessica Rutzick works
with a team of business consultants, including certified
public accountants, financial planners and bankers to
provide the best business advice to her clients. Because
of our success in litigation over the last ten years, we
recognize potential pitfalls a business may encounter
and therefore we are able to guide our clients around
those hazards and help them to avoid litigation in the
future. Should a dispute arise, Jessica will zealously
fight for her client’s interests while maintaining a
cost effective strategy aimed at resolution.
